Terms of Use

The rules and conditions that apply when you access, browse or use the CircularHire platform operated by Efficius GmbH.

1. Introduction

These Terms of Use govern your access to and use of the CircularHire website and related services operated by Efficius GmbH, Liebenwalder Str. 33, c/o PulsRaum, 13347 Berlin, Germany ("CircularHire", "we", "us", "our"). By accessing or using the platform, you agree to be bound by these Terms. If you do not agree, you must not use the platform.

2. Scope of the Service

CircularHire is a specialised job and talent platform for the Circular Economy. It allows organisations to publish vacancies related to circular products, materials, processes, services, supply chains and business models, and allows individuals to search for and apply to such vacancies. We may add, change or remove features at any time without prior notice.

3. Eligibility

You must be at least 16 years old to use CircularHire. If you create an account on behalf of an organisation, you confirm that you have the authority to bind that organisation to these Terms.

4. Accounts

When you register, you must provide accurate and complete information and keep your account credentials confidential. You are responsible for all activities that occur under your account. Notify us immediately at wirken@efficius.de if you suspect any unauthorised use.

5. Candidate Obligations

As a candidate, you agree that you will:

  • Provide truthful information in your profile and applications.
  • Respect the confidentiality of any information received from employers through the platform.
  • Not apply for vacancies with the sole purpose of harvesting employer data or contacting employers outside the legitimate application process.

6. Employer Obligations

As an employer, you agree that you will:

  • Publish only vacancies that genuinely exist and that comply with applicable labour, anti-discrimination and data protection laws.
  • Provide accurate information about the role, organisation, location, employment type and any circular contribution described in the posting.
  • Use candidate data received through CircularHire solely for the purpose of evaluating that candidate for the role they applied to, unless the candidate has given separate consent.
  • Not use the platform to send unsolicited commercial messages, advertise unrelated services or scrape candidate profiles.

7. Content You Submit

You retain ownership of the content you submit (profile information, CV data, job descriptions, company descriptions, images and similar). You grant CircularHire a worldwide, non-exclusive, royalty-free licence to host, store, display, reproduce and distribute such content on the platform for the purpose of operating, developing and promoting the service. You confirm that you have the right to grant this licence and that your content does not infringe the rights of any third party.

8. Prohibited Conduct

You may not:

  • Use the platform for unlawful, misleading, discriminatory or fraudulent purposes.
  • Post content that is defamatory, obscene, harassing, hateful or that promotes violence.
  • Attempt to gain unauthorised access to the platform, other accounts or related systems.
  • Use bots, scrapers or other automated means to access or copy the platform or its content except as permitted by our written consent or applicable law.
  • Circumvent technical measures, security features or usage limits.

9. Payment and Packages

Paid features (such as job postings, premium visibility or employer packages) are subject to the pricing displayed at the time of purchase. Fees are non-refundable except where required by law. We reserve the right to change prices for future purchases; existing confirmed purchases are honoured at the price paid.

10. Intellectual Property

The CircularHire name, logo, design, code, database and compiled job content are owned by Efficius GmbH or its licensors and are protected by applicable intellectual property laws. You may use the platform and download a single copy of materials for personal, non-commercial reference, but you may not copy, modify, distribute, sell or create derivative works without our prior written consent.

11. Third-Party Links

Job postings and company profiles may contain links to third-party websites. We do not control and are not responsible for the content, policies or practices of such websites.

12. Suspension and Termination

We may suspend or terminate your account or restrict access to the platform at any time if we reasonably believe that you have breached these Terms, that continued access poses a security or legal risk, or that we are required to do so by law. You may close your account at any time by writing to us at wirken@efficius.de.

13. Disclaimer

The platform is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not guarantee that the platform will be uninterrupted, error-free or free of harmful components, nor do we guarantee the identity, qualifications or behaviour of any user, employer or candidate.

14. Limitation of Liability

To the maximum extent permitted by law, Efficius GmbH shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, revenues, data or goodwill, arising from or related to your use of the platform. Our aggregate liability for any claim arising under these Terms shall not exceed the amount you have paid us (if any) in the twelve months preceding the claim, or one hundred euros (€100), whichever is higher. Nothing in these Terms limits liability that cannot be excluded under applicable law.

15. Indemnification

You agree to indemnify and hold harmless Efficius GmbH and its representatives from any claims, liabilities, damages and expenses (including reasonable legal fees) arising out of your breach of these Terms or your misuse of the platform.

16. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top of this page reflects when the current version came into force. Material changes will be communicated through the platform or by email where appropriate. Continued use of CircularHire after an update constitutes acceptance of the revised Terms.

17. Governing Law and Jurisdiction

These Terms are governed by the laws of the Federal Republic of Germany, excluding its conflict-of-laws rules and the UN Convention on Contracts for the International Sale of Goods. The exclusive place of jurisdiction for disputes arising from or related to these Terms is Berlin, Germany, unless mandatory consumer protection laws of your country of residence apply.
